Code be amended to include the concepts of experience, skill training, and responsibility as objective factors in deter- mining what is equal work; (3) that the Human Rights Code be made applicable to all other statutes unless specific exemptions are made in the Code itself; and (4) that the procedures for amending the Human Rights Code be en- trenched so that future alterations would require the agreement of a minimum of three—quarters of the mem- bership of the Legislative Assembly.
We recommend ( 1) that the Human Rights Code be amended so that any individual, whether directly aggrieved or not, may register a complaint under the Human Rights Code; (2) that the Human Rights Code be amended to allow for retroactive compensation; (3) that the penalties for violations of the Human Rights Code be increased; and (4) that the Human Rights Code provide that the anonymity of the complaintant be maintained to the extent that this is possible.
We recommend (1) that the Province of Prince Edward Island establish a Human Rights Commission consisting of civil servants and members of the public with one-half of the members to be women; (2) that the Commission be responsible for the administration of the Human Rights Act; (3) that the Commission be supplied with adequate support staff to carry out its duties: (4) that the Commission be responsible directly to the Legislative Assembly; (5) that the Commission have powers to investigate complaints of violations of the Human Rights Code; (6) that the Com- mission be charged with the task of acquainting the mem— bers of the public in the province with the extent of human rights; (7) that the Commission be given authority to render decisions and, where necessary, to impose penalties as the result of their investigations; (8) that the Commission be given sufficient power to impose retroactive compensations wherever warranted; and (9) that the decisions of the Commission be subject to appeal within the existing judicial system providing that appeal proceedings are launched no later than 6 months after the Commission has rendered its final decision on a complaint.
We recommend that the Prince Edward Island Department of Justice consider amendments to existing legislation so (1) that matrimonial property law in the province will recognize the concept of equal partnership in marriage in such a way that the contribution of each spouse to the marriage part- nership will be acknowledged and that, upon dissolution of the marriage, each will have a right to an equal share in the assets accumulated during marriage otherwise than by gift
