[573' CAP. XI. A By-law Relating to Auctioneers BE it enacted by the City Council of the City of Charlottetown, as follows : 1. That licenses for selling by auction in the city shall be granted by the City Council, and “m“ Fee shall be made out and issued by the Mayor. upon payment to the City Treasury of a fee of Fifty Dollars, to any person applying for the same being a resident in said city, and of One Hundred Dollars to any person not having been at the time of such application a resident in said 5 city for the space of three months consecutively before such application, and every such license shall continue in force for one year. ' 2. No person shall act as an auctioneer within the city without being thereto licensed as 31mm aforesaid; but nothing herein contained shall extend to sheriffs or other officers selling under process of law, or by the decree or direction of any court. 3. Any person or persons guilty of an infrac- Penal Chums tion of any of the provisions of this By-law shall, upon conviction in the City Police Court of the Stipendiary Magistrate, on the oath or affirmation of any credible witness, forfeit and pay, at the discretion of the said Magistrate a penalty not exceeding the sum of Thirty Dollars for each offence, exclusive of costs; and in default of payment thereof forthwith, it shall and may be lawful for the said Magistrate to commit the offender or offenders to the Com- mon Jail of the city for any period not exceeding thirty days, unless the said penalty and costs be sooner paid. ‘
