trees, as the Mayor and City Council may from time to time approve of. The trees so planted

shall be, and shall be held and considered to be, the property of the City of Charlottetown.

2. The standing committee for the streets and squares shall determine in what manner the respective squares are to be planted, and the City Surveyor is to be guided by the directions of the said committee, furnished him for that purpose in writing.

3. No person shall cut down, bark, lop or otherwise injure any tree planted under the authority of this By—law, or any tree now planted and growing upon any street or square in the said city, or shall cut down, break or otherwise injure the boxes, supports, or other appendages to or around any such tree.

4. No person shall fasten horses, whether harnessed or otherwise, to any such trees, or to the boxes around the same.

5. Any person or persons guilty of an infraction of any of the provisions of this By-law shall, upon conviction in the City Police Court of the Stipendiary Magistrate, on the oath or affirmation of any credible witness, forfeit and pay, at the discretion of the said Magistrate a penalty not exceeding Twenty—five dollars for each offence, exclusive of costs ; and in default of payment thereof forthwith, it shall and may be lawful for the said Magistrate to commit the offender or offenders to the common jail of the said city for any period not exceeding thirty days, unless the said penalty and costs be sooner paid.
