Tenders for removing night-soil Where filth not. to be deposited [68] privies or otherwise, through the said city, shall only do so between the hours aforesaid, and shall then convey the contents thereof in such tight or properly covered carts or vehicles as shall not permit the stench thereof, or any portion of said contents to escape, slop, or spill thereout, and every person offending against the provisions of this section, shall be subject to the penalties of this By—law. II. The said Board of Health may accept tenders for the removal ofnight—soil, and it shall be the duty of every person authorized to remove such soil, to remove or cause to be removed, from the premises of any of the inhabitants within the said city, the night—soil accumulated therein, and to deposit the same in some place, under the restrictions and subject to the directions of the said Board : Provided always, that no greater sum shall be charged the person or persons from whose premises such might—soil be removed, than is named in the tenders accepted by the said Board of Health; and should the contractor at any time, fail to remove such night-soil within forty-eight hours after having been notified so to do, the sanitary officer of the said city shall have power to employ other parties to do such work, and the excess of cost, if any. shall be paid by such contractor. 12. It shall not be lawful for any person or persons within the said city to deposit upon any of the streets, lanes, squares, or upon any land or lot, or on any part of the beach or shores, or on any wharf or breastwork within the said city any night—soil, manure, or other filth or refuse matter of any kind, without the consent and under the direction of the said Board.
