When or so often as any offences against the provisions of this law shall be committed, it 53,22,” 0’ shall be lawful for any police constable or any of the city authorities, on his own View, or on complaint and information of any person, to order to be taken, or to take into custOdy any such offender forthwith. without any other warrant or authority than this law, and convey such offen— der before the City Police Court. or have security taken for their appearance in said Court, to be dealt with for such offence accord— ing to law. 5. Any person or persons guilty of an infrac- tion of any of the provisions of this By-law shall, Penal clause upon conviction in the City Police Court of the Stipendiary Magistrate, on the oath or affirma- tion of any credible witness, forfeit and pay at the discretion of the said Magistrate, a penalty not exceeding thirty dollars for each offense, exclusive of costs; and in default of payment thereof it shall and may be lawful for the said Magistrate to commit the offender or offenders to the common jail of the said city for any period not exceeding thirty days, unless the said penalty and costs be sooner paid.
