[83] CAP. XVIII. i. Bylaw relating to Lamps. BE it enacted by the City Council of the City of Charlottetown, as follows :— I. That whosoever shall wilfully, maliciously, carelessly or wantonly break, throw down, extinguish or otherwise injure any of the city gas or electric light lamps or globes, or the posts, irons, or other fixture, to the same belonging, shall be subject to the penalties of this By-law ; and all penalties inflicted under this Act shall go, the one moiety‘thereof to the use of the city funds, and the other moiety thereof to the person who shall prosecute for the same; and any person or persons committing the same depredations on lamps and posts, being the property of private persons, or lamps and posts put up at their expense, shall be subject to the penalties of this Act. 2. Any person or persons guilty of an-in- fraction of any of the provisions of this By-law, shall, upon conviction in the City Police Court. of the Stipendiary Magistrate, on the oath or affirmation of any credible witness, forfeit and pay, at the discretion of the said Magistrate, a penalty not exceeding Twenty Dollars for each offence, exclusive of costs; and in default of payment thereof, it shall and may be lawful for the said Magistrate to commit the offender or offenders to the common jail of the said city for any period not exceeding thirty days, unless the said penalty and costs be sooner paid.
