     toes hereunder, shall, on demand, refuse or neglect 
     
    

    
     to pay the same, such person shall forfeit the. 
     
    

    
     sum of two dollars in addition to the amount 
     
    

    
     due by such person for such weighing, and the 
     
    

    
     Coal Meter and Weigher applying for the same 
     
    

    
     is hereby authorized in his own name as such 
     
    

    
     Coal Meter and Weigher, to sue for and recover 
     
    

    
     such fine and amount due for weighing, before
