12. Any person or persons who shall be guilty of any infraction or breach of any of the provisions of this By-law, shall for each and ”mam” '

, every offence, upon summary conviction therefor before the Stipendiary Magistrate of the City of Charlottetown, forfeit and pay a fine of fifty dollars, when the fee for such license is twenty dollars and upwards; and a fine of twenty dollars when the fee for such license is from ten to twenty dollars ; and a fine of ten dollars when the fee for such license is less than that amount ; to be‘sued for, prosecuted and recovered in the name of the City Collector for the time being, and in default of payment of the said fine, imposed with costs forthwith, it shall and may be lawful for the said Magistrate to commit the offender or offenders to the common jail of Queen’s County. for any period not exceeding sixty days, in the discretion of the said Magis— trate, unless the said penalty and costs be sooner paid.
