case of illness, then and in every such case such person shall immediately become disqualified and shall cease to hold the office of Mayor or Councillor as aforesaid.

6. On the second Wednesday in February, A. D 1904, the Mayor and all the Councillors of the said City shall go out of' Office, and on the same day in every second year thereafter the Mayor and all the Councillors shall go out of office.

7. The Mayor and Councillors shall continue in office until their successors shall be elected, or they themselves be re-elected, and when any vacancy shall happen in the Council by death, resignation or otherwise, the person elected to fill the same shall hold office until the period at which the person in whose stead he shall have been elected would in the ordinary course have gone out of office

8. If an extraordinary vacancy shall occur in the ofi‘ice of Mayor or Councillor of the said City the

‘persons qualified to vote shall, on a day to be fixed by

the Mayor or a majority of the Councilmen (such day not being later than thirty days after such vacancy), elect from the persons qualified to fill such office another person duly qualified to fill such vacancy; and such election shall be held, and the voting and other proceedings be conducted in the same manner and subject to the same provisions as are hereinafter provided.

9. It shall be lawful for any person holding the office of Councillor to resign his said office at any time by a declaration to that effect, under his hand and on the payment of a fine of sixteen dollars, and a Councillor shall be elected in the manner aforesaid for the Ward for which such Councillor so resigning was elected.
