The name of each Elector voting at such Names“ elections shall be written in poll books under appro- {gitggfiageged priate heads to be kept at such election by the Returning Officer, who shall at the close of each election (in case no person who had voted at the same election shall then publicly demand a scrutiny) forthwith proceed publicly to declare the number of votes given for eachccandidate or person for whom votes shall have been taken, and shall declare the person or persons having the majority of votes in his or their favor to be duly elected; and if there should be at the final closing of the Poll as aforesaid an gggggiggust equal number of votes polled for two or more persons, 5;}: 05‘5““? it shall be lawful for the Returning Officer, and he is hereby required whether otherwise qualified or not, to give a vote for one or other of the persons having such equality of votes, in order to give a majority to . one of them, and determine the election; and the Poll p011 Bookm Books kept at such election shall by the Returning figflgfifd ‘0 Ofiicer be delivered on the day after the conclusion of every such election to the Clerk of the City, to remain in his office where they shall be open to inspection by any elector, and at the same time the said Returning Officer shall make due Return to the City Council that the candidate having the greatest number of votes for the office of Mayor has been duly Returinng elected, and that the candidate or candidates (as the Officers to case may be) having the greatest number of votes for make returns the office of Councillor has been elected; and the person or persons so returned shall be deemed and held the Mayor of the City and the Councillor, or Councillors, for the several wards for which he or they are elected ; and such return shall be conclusive Returnscon. evidence of the due election of the person or persons giii'dlgrice therein returned elected, and of the regularity and happening of every pre-requisite necessary to holding
