take out of the said City all night soil, manure, ashes, or refuse matter of any description, upon such terms and conditions as they shall deem most advisable.

163. The above four sections of this Act shall apply to that portion of the Common and Royalty of the said City situate at or near the spring situate at Spring Park, on the Malpeque Road, and so that all lands and premises within a radius of half a mile of said spring, and the owners and occupiers thereof shall be as fully subject to the provisions thereof as if such land and premises, owners and occupiers were within the city limits.

164. The City Council shall annually appoint one special sanitary officer whose duties shall be to see that the requirements of this Statute are kept and observed, and to enforce the By-laws of the City, and of the Board of Health in all sanitary matters, and to prosecute all offenders before the Stipendiary Magistrate of the City, and generally to enforce cleanliness in the said City, and the salary of such officer shall not be less than one hundred dollars to be paid out of the City funds.

165. Any person _or persons guilty of an infraction of any of the above sanitary provisions of this Act. shall upon conviction in the City Court ofthe Stipendiary Magistrate on the oath or affirmation of any credible witness, forfeit and pay at the discretion of the said Magistrate, a penalty not exceeding thirty dollars for each offence, exclusive of costs. and in default of payment thereof it shall and may be lawful for
