4. FRANCIS WILLIAM PIUS BOLGER b. July 8, 1925, was ordained a priest, at St. Ann’s Church, Hope River, June 10, 1951. Father Bolger received his PhD. from the University of Toronto in May, 1959. He taught at St. Dunstan’s University and at the University of Prince Edward Island from 1959 until 1994. He was named Professor Emeritus of the University and a Member of the Order of Canada in 1994.
THE SUTHERLAND PROPERTY
The last property on the North Road as we move from South to North is the John Sutherland property which was situated immediately north of the 50 acres homestead originally in the hands of Alexander Pickering and later Thomas and Margaret Bolger. On March 31, 1840, John Sutherland Sr. acquired a lease of 71 acres of land. On January 10, 1905, the deceased John Sutherland’s family, John, George and Jessie arranged for the purchase of the land and by February 2, 1905, the 71 acres was paid for in full at a cost of $105.50, and a deed was issued to John, George, and Jessie Sutherland. Through the next few years, 26 additional acres of land was purchased and the Sutherland homestead now comprised 97 acres of land. George passed away and on December 22, 1921, John Sutherland died. He was the anchor person on the Sutherland homestead, and his sister Jessie, was now alone. A.E. Fyfe and Simpson Bell were the executors of John Sutherland’s will. His will, which his immediate neighbour, Thomas Bolger and Joseph Reid witnessed, specified that the “farm of 97 acres of land on which I now reside at Stanley Bridge in Lot 22, together with all stocks, crop, farming implements, car- riages, household furniture of which I am possessed at my death, to be sold and one—half to put in the Bank of Nova Scotia for my sister, Jessie Sutherland and the other half to be given to the Bible Society”. The property was appraised at $2,500.00 and the personal property at $175.00
Mr. Fyfe assumed much of the responsibility for the management of the property. On August 25, 1923, A.E. Fyfe purchased the 97 acres of land from Jessie Sutherland for $2,600.00. Some $905.00 was owed in mortgage and rent arrears leaving a balance to Jessie Sutherland and the John Sutherland Estate of $1 ,695.00.
John Sutherland’s share of this was $847.50 and against this were debts of $524,84. The bal- ance was $321.66 and the executors received $17.00. The residue was $304.66, Jessie Sutherland’s share was one-half, and the British Bible Society received one—half.
Jessie Sutherland died intestate on the 26th of January, 1927 without leaving any heirs on PEI, and the only relative was a cousin Sarah B. Ives of Marlborough, Massachusetts, USA. The Court Citation states:
“After her brother’s death, Jessie Sutherland conveyed her interest in the said land to the execu- tors, A.E. Fyfe and Simpson Bell, and they in return conveyed to the said Jessie Sutherland a life interest in part of said property including the dwelling house and the outbuildings thereon in order that the said Jessie Sutherland might be maintained and kept on the said premises during her lifetime having otherwise refused to join with said executors on sale of said land.
The said lands was subject to a mortgage and after paying mortgage and John Sutherland’s funeral and testamentary expenses the land would amount to about $1000.00. That the deceased had livestock worth about $800.00. That the petitioners have become liable for the
